Payment Terms

These terms contain a Driver Payment Services Agreement and Client Payment Terms. Review the agreement that applies to you before you use Esca payments.

For drivers

Driver Payment Services Agreement

This agreement applies when a private driver receives or may receive money through Esca. You accept it when you select the agreement control during account creation or continue to use Esca payment services after an updated agreement takes effect.

1. Your business and information

You provide private-driver services as an independent business. You are not an employee, agent, partner, or representative of 6060 Labs, Inc. You control your rides, service, pricing, licences, permits, insurance, taxes, and client relationships.

You must provide complete and accurate legal, contact, tax, bank, and business information. You must promptly update it when it changes. You may not use another person's identity, account, bank details, or Esca profile.

2. Lawful use

You may use Esca payments only for genuine private-driver services that you provided or agreed to provide. A payment can include a tip or an unpaid service balance.

You may not use Esca for a gift, personal transfer, loan, cash advance, card testing, money laundering, sanctions evasion, or another person's business. You may not create a false ride or payment purpose. You may not process a payment for unlawful goods, unlawful services, or any use prohibited by Stripe or a card network.

If 6060 Labs reasonably determines that a payment, ride, service, or payment purpose is unlawful, fraudulent, prohibited by these terms, or contrary to Stripe, bank, or card-network rules, 6060 Labs may hold, block, cancel, reverse, or report the payment; refuse to release funds to the driver; and refund all or part of the payment to the client. To the fullest extent permitted by law and applicable payment rules, the platform service fee is earned when the payment is processed and may be retained when 6060 Labs refunds the amount otherwise designated for the driver. 6060 Labs may return the platform service fee at its discretion or when required by law, Stripe, a card network, a bank, or a government authority.

3. Stripe and identity checks

Esca uses Stripe for payment processing, connected accounts, and payouts. Your use of these services is also subject to the Stripe Connected Account Agreement. Stripe can request identity, tax, business, bank, or other information.

6060 Labs may require identity or risk checks before it accepts a payment or releases funds. These checks can include a government-issued photo ID and a matching selfie. You authorize 6060 Labs to use Stripe or another service provider for these checks. Passing a check does not create a public Esca Verified badge.

4. Platform service fee and driver share

Each payment includes a platform service fee equal to 10% of the total payment. This fee helps 6060 Labs operate, secure, support, and maintain Esca and its payment service. Subject to this agreement, the remaining 90% is designated for you. Esca does not add the platform service fee above the total shown to the client at checkout.

The platform service fee is not the same as Stripe's processing or payout fees. Your share can be reduced by refunds, disputes, chargebacks, reversals, penalties, taxes, processing costs, instant-payout fees, and other amounts that you owe under this agreement.

5. Holds and release

6060 Labs may hold funds while it reviews your identity, Stripe account, payment, service, dispute, fraud risk, sanctions status, or compliance with these terms. You must complete all requested steps before release. A displayed balance is a record of funds that may become payable. It is not a bank account, stored-value account, or promise of release.

Release also depends on Stripe, bank, and card-network availability. 6060 Labs may delay, cancel, reverse, or refuse a release when it reasonably believes that action is needed to protect a client, 6060 Labs, Stripe, a bank, or a card network.

6. Refunds, disputes, and chargebacks

6060 Labs may issue a full or partial refund when required by law or payment rules, when a payment is disputed, or when it reasonably finds that the payment or service was invalid. Refunds normally return to the original payment method.

Stripe or a card network can remove the full payment and related fees from the 6060 Labs balance. This can occur even after 6060 Labs released your share. This agreement cannot guarantee that 6060 Labs will retain the platform service fee.

7. Your repayment and recovery duties

You are responsible for refunds, chargebacks, dispute fees, penalties, processing costs, transfer reversals, and losses linked to your services, conduct, account, or breach of this agreement. You must repay 6060 Labs when it pays one of these amounts for you.

To the fullest extent permitted by law, 6060 Labs may deduct an amount you owe from any current or future funds payable to you. It may reverse a transfer, debit an eligible Stripe balance, use another lawful recovery method, or refer the debt for collection.

8. Taxes, licences, insurance, and records

You are responsible for all taxes, tax forms, licences, permits, registrations, insurance, and records that apply to your services. You must provide records that 6060 Labs reasonably requests for a payment, dispute, refund, audit, or legal duty.

Esca does not confirm that you may legally provide a ride. Payment access does not confirm your driving licence, driving record, insurance, vehicle safety, or local for-hire authority.

9. Suspension, termination, and unclaimed funds

6060 Labs may limit, suspend, or end payment access for risk, noncompliance, false information, unlawful activity, Stripe restrictions, or a breach of these terms. This does not remove amounts that you already owe.

6060 Labs may return unresolved direct payments to the original client after the stated hold period. Other unclaimed funds will be handled under applicable unclaimed-property law. You must keep your contact and payout information current.

10. No escrow or fiduciary relationship

Esca is not an escrow service, bank, money-market account, or trustee for you. No fiduciary relationship arises from a payment, hold, balance display, or release. You have no ownership right in a specific Stripe balance or bank account.

11. General legal protections

You will defend and reimburse 6060 Labs and its officers, directors, employees, and agents for third-party claims, losses, penalties, and reasonable costs caused by your services, conduct, unlawful use, taxes, or breach of this agreement.

To the fullest extent permitted by law, Esca payment services are provided as available and without implied warranties. 6060 Labs is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Its total liability for a payment claim will not exceed the amount of that payment.

A legal right that cannot be waived remains in effect. If one part of this agreement is unenforceable, the remaining parts continue. A delay in enforcement is not a waiver. 6060 Labs may update this agreement and will state the new update date on this page.

For clients

Client Payment Terms

1. Who operates Esca and what these terms cover

6060 Labs, Inc. operates Esca. These terms apply when you use Esca to pay a named private driver. They cover public direct payments and payments linked to an Esca ride.

Stripe processes the payment and protects your card or wallet details. Esca does not store your full card number. Stripe's terms can also apply to your payment.

2. Acceptance and electronic records

You accept these terms when you select the agreement control or continue to payment after Esca shows a link to them. You agree to receive payment records, notices, and receipts electronically. Keep a copy for your records.

3. Permitted private-driver payments

You may use Esca only to pay the named driver for genuine private-driver services. The payment can include a tip or an unpaid balance for those services.

You confirm: “This payment is for lawful private-driver services from the named driver, including a tip or unpaid balance. It is not a gift, personal transfer, loan, cash advance, or payment for another person's business.”

4. Prohibited, fraudulent, and unlawful payments

You may not use Esca for a false ride, a false payment purpose, card testing, money laundering, sanctions evasion, unlawful goods or services, or another merchant. You may not use a payment method without the account holder's permission.

If 6060 Labs reasonably determines that a payment, ride, service, or payment purpose is unlawful, fraudulent, prohibited by these terms, or contrary to Stripe, bank, or card-network rules, 6060 Labs may hold, block, cancel, reverse, or report the payment; refuse to release funds to the driver; and refund all or part of the payment to the client. To the fullest extent permitted by law and applicable payment rules, the platform service fee is earned when the payment is processed and may be retained when 6060 Labs refunds the amount otherwise designated for the driver. 6060 Labs may return the platform service fee at its discretion or when required by law, Stripe, a card network, a bank, or a government authority.

5. Payment authorization

You authorize Stripe and 6060 Labs to charge the total shown at checkout. You confirm that the payment details are accurate and that you have authority to use the selected payment method. Your bank can apply its own terms and fees.

6. Driver and underlying-service responsibility

The named driver, not 6060 Labs, provides the ride or other private-driver service. The driver is responsible for service quality, safety, pricing, licences, permits, insurance, taxes, and legal compliance.

6060 Labs does not guarantee a ride, verify that a ride occurred, set every driver price, or resolve every service complaint. A payment does not create a ride, booking, connection, review, or other service record unless Esca states otherwise.

7. Security review and payment holds

6060 Labs, Stripe, a bank, or a card network may review, delay, hold, block, or cancel a payment for fraud, sanctions, identity, service, dispute, or compliance reasons. 6060 Labs may request information that reasonably supports the payment purpose.

8. Release, refunds, disputes, and chargebacks

A driver must meet Esca and Stripe release requirements before receiving the driver share. 6060 Labs may issue a full or partial refund when these terms, law, Stripe, a bank, or a card network permits or requires it. A refund goes to the original payment method unless applicable rules require another method.

Bank processing times can delay a refund. An active card dispute can pause a separate refund. Stripe and the card network decide the dispute outcome. Their decision can remove the full payment and related fees from the 6060 Labs balance.

9. No escrow or guaranteed release

Esca is not an escrow service, bank, stored-value account, or trustee. Money held in the 6060 Labs Stripe platform balance is not kept in an escrow account. A driver has no guaranteed right to release while a hold, refund, dispute, legal duty, or payment rule applies.

10. General legal protections for 6060 Labs

To the fullest extent permitted by law, Esca payment services are provided as available and without implied warranties. 6060 Labs is not liable for the driver's acts, omissions, services, vehicle, or statements.

6060 Labs is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Its total liability for a payment claim will not exceed the amount of that payment. Your nonwaivable consumer rights remain in effect.

You must reimburse 6060 Labs for losses and reasonable costs caused by your unlawful use, false information, unauthorized payment method, or breach of these terms. If one part of these terms is unenforceable, the remaining parts continue. A delay in enforcement is not a waiver.

11. Your payment

The amount you authorize includes a platform service fee equal to 10% of the total payment. This fee helps 6060 Labs, Inc. operate, secure, support, and maintain Esca and its payment service. Subject to these terms, the remaining 90% is designated for the named driver. Esca does not add the platform service fee above the total shown at checkout.
